green card

hi prab,
my program has offered me H1 visa. i had a few doubts regarding h1 to gc conversion.
1. where do i get info regarding employers who would initiate gc processing?
2. can a prospective employer initiate the gc processing while i am doing my 2nd yr of internship? ( or when is the earliest that this can be done?)

thanks

thanks prab! k..let me brief

thanks prab!

k..let me brief u regarding my situation. me and my kid were staying on L2 as dpendents of my husband who is on L1. i recently found out that it is possible for a L2 holder to switch to H1 and get a fresh 6 yrs. now the problem is with my kid's status. im planning to convert her status to H4 (as my dependent). number of yrs she already stayed on L2 would be counted against the number of yrs on H4, which would leave her only with 3 yrs on H4. after that she would have to leave the country for 1 yr.
now...im thinking of ways by which that can be avoided. found out from a forum that by filing for GC, stay on H1 & H4 could be extended, provided "labor certification" is applied 365 days before applying for H1 renewal. im here racking my brains as to how to go about this sticky situation.
how would i apply for labor certification before H1 renewal( i presume renewal is done after 3 yrs on H1)? for that to happen, someone should hire me during the 2nd yr and start the GC processing. would employers do it if i tell them that im ready to bear the expenditure?
could u please give me some pointers with regard to this whole mess.
thanks in advance!

Hi, While it is possible for

Hi,
While it is possible for a prospective employer to initiate GC application, it is unlikely to happen when you have not yet completed residency since there will be a lot of ifs and buts. Also, most employers do not think of hiring people in first or even second year of residency but they do in the third year. To be practical, I think you might have to wait until you complete residency and start a job before asking an employer to file for a GC. Also, most employers may want to see you work for them a few months or so before they can consider filing for GC. All the best.
